Estate Planning ? Guidelines And Trustees, Legal - Tera88

If you are wisely attempting to place some property into a trust (inter vivos) in your lifetime, then you could have been taking note of the necessary differences between wills and trusts. A trust created throughout your life will likely be far more secure with respect to its potential to withstand challenges to how your property are to be distributed throughout property planning than a will. Making a belief is a courageous factor to do, as a result of it telegraphs, to a sure extent, what you are going to do along with your property while you are nonetheless alive. That is what insulates it from assaults on your capability, because it is unlikely, for instance that, one in every of your relations is going to say you might be insane or feeble and unduly influenced by one other of your relatives to your face and this makes the trust a far surer wager than a will, in some cases.

Nonetheless, the belief additionally may engender exhausting feels relating to the exclusion of a relative and those feelings will become recognized to an individual creating a belief whereas they?re still alive. This is the advantage of a will ? if people don?t like it, you will by no means know. The need maker is lengthy gone when people who do not like what they?ve done contest the need and those that do prefer it try to defend it. Although, it must be famous that intelligent drafting should be able to alleviate the necessity of either a contest or a defense. That is why you want an intelligent property planning lawyer to create your will rather than only a form. The attorney that creates your will often defends its contents, or in other words, their understanding of your wishes. The trust is a different story, as a result of your trust shall be administered by someone (referred to as the trustee) for the purpose of those that the trust advantages (the beneficiaries).

One of the paramount problems of forming a belief is deciding what powers the trustee has and what powers they do not have relative to the property you?ve placed in trust. Do not forget that a trustee is already assumed to have a duty to learn the trust and that many states have laws concerning what a trustee can and can?t do, if the settlor (the creator of the belief) doesn?t specify otherwise. However, once more, you don?t wish to leave the financial destiny of your trust as much as the state any greater than you want the state to decide who gets your assets. Your wills and trusts lawyer will have the ability to give you an inventory of the standard powers of a trustee in your state and tell you what they mean. Most of the powers concern what sort of assets the trustee can put money into on behalf of the trust. For instance, the trustee is typically prohibited from shopping for general securities for the belief as a result of they?re thought-about too risky. However, when you?ve got chosen your trusted inventory dealer as your trustee and she has agreed, then this is likely to be exactly the restriction you do not want. Consult with your legal professional in regards to the type of belief you wish to create and what the rules are in your state. Keep in mind, that these guidelines are there to cover the bases in case you do not make your personal rules. Understanding the rules which are there, and why, provides you with a sense of the sorts of guidelines that is perhaps good and those that you would moderately not have. In addition, it is possible for you to to give the trustee more freedom than the state guidelines would allow, or much less, depending on how conservatively you want your belongings to be managed.

Be ready to have a candid conversation together with your attorney relating to what the foundations are and what you wish to see happen. It is good to keep in mind that your estate planning lawyer has seen many trusts and understands how they work. Typically restrictions that appear good as we speak might be the very restrictions that cripple your trust in a vastly different economic environment. In some instances, a belief could span several a long time and the trustee could change together with the climate the trust was created in. When radical economic changes have occurred, a belief with better flexibility can be beneficial. So you might have a lot to think about as you enter the thrilling world of forming a trust. Don?t let rules be off-placing, they are there as guides and when you understand them you should have a better understanding of what you need. Ask your estate planner to provide you details about the current guidelines and some normal advice about how to decide on a trustee.

Dr. Richard Palmquist: People and Pets Need Help With Weight Issues

The word "doctor" means "one who teaches," and we can tell how well we do this in our practices by simply looking in the waiting room. If doctors teach well, then people will understand their veterinary care and make wiser health choices, and that should translate into healthier patients. Caring, competent professionals want to make a difference in the health and longevity of their patients. They attend conferences, form special interest medical study groups and participate in research to find things that improve patient health and quality of life. Most veterinarians work hard to educate their clients so they can act intelligently and make choices that improve the health of their animal charges and make everyone's lives better.

A recent survey of the characteristics of aging pets and their owners highlights several issues that suggest a need for improved client and professional education.[1] In the survey, 14 percent of cats and 18 percent of dogs were overweight. In addition, 87 percent of cats and 49 percent of dogs were fed by leaving food down at all times, a practice known to increase chances of obesity.

According to the study, overweight cats and dogs were much more likely to be owned by people who were likewise affected, and the survey indicated that overweight owners and animals had poorer health. This was particularly true for elderly owners. These results suggest we need to do a better job in educating our clients about proper feeding, and it is highly likely that we could make major improvements in health by successfully educating clients about these factors. It also shows how veterinary health and human health are related.

Obesity is known to be a major health issue. Obesity is linked to over 150 billion dollars a year in added health costs for human medicine, and statistics suggest that as many as 300,000 people die prematurely from complications associated with being obese.[2] In human medicine we know that obesity is associated with the following health challenges:

  • High blood pressure.

  • Diabetes, type two.

  • Joint problems and arthritis.

  • Sleep apnea and difficulty sleeping.

  • Heart disease.

  • Cancer.

Recent studies suggest that we see similar risks from obesity in dogs and cats, although overweight dogs may not have increased risks of heart disease. We do know that animals are susceptible to increasing cancer rates and pain associated with arthritis from being overweight.[3]

Good health and recovery from disease are dependent upon proper nutrition and activity. Dogs and cats evolved to address their health needs through nutrition. They naturally seek out and ingest green materials that have powerful antioxidant, anti-inflammatory and medicinal nutritional properties. The fiber in green foods also helps improve digestion and elimination in several ways as toxins bind to fiber, which carries it out of the body, and fiber also supports healthy bowel bacteria. Those probiotic bacteria create health in the bowel through improved immune status and assist in digestive system maintenance. They may even assist in prevention of allergic issues like asthma.[4],[5].[6] Proper nutrition also appears to affect brain development in juveniles.[7] Science is starting to appreciate the importance of nutrition and bacteria on the development of obesity.[8]

We humans can learn a thing or two from those behaviors.

We should not wait until our pets or our loved ones are overweight to begin eating healthier. The truth is that eating properly should begin at birth and continue through their lives. This is so important. The following rules will help you in this area:

  • Feed a diet that is made of quality ingredients. The less processed foods are, the simpler they will be to digest and utilize. Feeding some fresh food is desirable in most cases. Green foods contain chlorophyll which can be a potent antiinflammatory agent. It may even reduce cancer development. [9]
  • Feed appropriate calories for activity. Feeding a high-calorie diet to an inactive or aged pet is sure result in obesity. In most cases it is much better to feed dogs and cats twice daily and measure their food so that they receive the appropriate amount of calories and nutrition. Free-fed pets tend to develop weight problems. Generally, if your pet is overweight you need to restrict the amount fed by 20-50 percent. As their weight drops you can adjust their intake to stabilize weight. Caution should apply with cats as restricting their intake too severely can lead to liver stress and disease. Because of this it is a good idea to consult with your pet's veterinarian before embarking on a weight loss program.
  • Feed to maintain a lean body condition. Ask your veterinarian for assistance in determining the correct amount of food for your pet. A good general rule is to feed an amount of food that allows you to feel their ribs under the elbow area of the chest. The ribs should be palpable but not prominent. Please understand that the tables on pet food bags are notoriously inaccurate for determining the correct amount of food for your pet. Use them only as very rough guides.
  • For cats, feeding canned food is preferred over dry. Dry foods are often harder to digest, rob the body of needed water, contain too many cereal grains and may lead to unnecessary stress on their digestive and urinary systems. Some dry foods contain excellent ingredients but can contain extremely high calorie counts. These foods are so energy-dense that only a half-cup provides a cat's entire daily caloric requirements. Cats that are free-fed these diets likely ingest far too many calories each day, and have no choice but to store extra fat and develop obesity.
  • Get ample exercise and play each day. It is critical that your pet move and use the calories they ingest each day. The body does not want to accumulate fat. The fat cells immediately release chemicals that suppress appetite and stimulate movement so that their contents get used. But if we feed incorrectly, then fat accumulates and metabolism starts to favor high insulin levels, inflammation and even cancer.

It only takes a bit of common sense to make changes that improve health potential. As we learn more, we see the importance of these simple actions. Take a few minutes of your pet's annual veterinary visit to discuss these things with your doctor.

98% The Island President

In the simultaneously inspiring and harrowing documentary "The Island President," Mohamed Nasheed was elected to the presidency of the Maldives, a 2000 island archipelago nation in the Indian Ocean, bringing an end to a thirty-year repressive dictatorship in 2008. But a new struggle presents itself in global warming. Currently, the effects there can be seen in erosion and the groundwater. All of which could lead to a unique culture and nation being literally wiped from the map, and its country's population turned into 'environmental refugees.' So, instead of spending valuable resources on health care and education, he has to go with sea walls and other protective measures. So, through this example, we get a disturbing look at what all of our futures may be like if we do not change our ways very soon.(With the use of some great shots, the Maldvies do seem like something out of speculative fiction.) If our behavior affects all others across the globe, then why can't the butterfly flap its wings in the opposite direction, which is where Nasheed comes in, not only in speaking across the world(I'm not recommending invoking World War II usually in speehces, but if you have to, mention Czechoslovakia), but also in proposing to make his country entirely carbon neutral in 10 years by relying on renewable energy sources like solar and wind, making the Maldives an example for the rest of the world. This is harder than it sounds with the economic interests of countries like China and India making things especially difficult with a memorable climax at the climate conference at Copenhagen in 2009. But sadly, Nasheed did not have that much time as he was ousted in a threatened coup in February of this year.

Finnish army chooses networked battlefield communications and ...

Posted by John Keller

HAIFA, Israel, 29 May 2012. Leaders of the Finnish army based in Mikkeli, Finland, needed battlefield communications and intelligence, surveillance, and reconnaissance (ISR) equipment for the services infantry soldiers. They found their solution from Elbit Systems in Haifa, Israel.

Elbit will supply the company?s Dominator enhanced observation soldier equipment, situational awareness software, combat radios, and wearable computer systems under terms of a contract from the Finnish army, as well as support the military service in developing new combat doctrines for the Finnish army?s future forward observation programs. The amount of the contract was not disclosed.

Dominator will help enhance the Finnish army?s situational awareness with networked integrated information systems that enable warfighters to send and receive information in real time, view an up-to-the-minute common operational picture of enemy and their own forces on personal displays, as well as live video from either external or on-body sensors and transmit images and positions back to commanders and colleagues.

Dominator has the Elbit Systems C4I SW software developed to assure simple, swift operation in intense combat. It supports planning, situational awareness, target handling, and device connectivity, as well as video and map displays.

Elbit?s C4I SW software also provides command and control for light infantry forces, and interfaces to armored units, artillery, and close air support units.

The Australian army also has chosen parts of the Dominator concept for its Land 75/125 program, in which Elbit Systems will provide battle group and below command, control and communications (BGC3) systems for Australian soldiers, vehicle mounted commanders and headquarters/command post staff, under terms of a $298 million contract.

Dominator interfaces with existing communication equipment to enable every soldier to be a sensor, Elbit officials say. Dominator equipment includes a ruggedized tactical computer called the personal digital unit (PDU); the Tactical Intranet Geographic Dissemination in Real-time (TIGER) system that unifies communications channels into a tactical intranet; wearable camera and eyepiece to transmit and receive live video; hand-held display; and wireless local area network.

The PDU provides data processing and storage, and has an integrated Global Positioning System (GPS) that interfaces to other battlefield communications devices, with an optional PCMCIA advanced tactical modem to enhance radio performance.

The TIGER system provides tactical intranet and creates interest-based, geographic data dissemination. TIGER provides message transfer, flow, and continuous delivery.

The eyepiece display has built-in line-of-sight sensors and can be mounted on a helmet, on the warrior?s vest, or as part of the weapon-mounted fire control system.

The hand-held display is a compact, portable, sunlight-readable display packaged in a 5.6- or 8-inch touch-panel screen with operation function keys to sow command-and-control information and streaming video.

The MaXess broadband military wireless LAN supports live video transmission and reception based on advanced ad-hoc networking protocols.

Although Dominator interfaces with any communications device, it is designed to work best with the Tadiran PRC-710 MB advanced, secured multi-band (30-512 MHz), frequency-hopping hand-held radio that operates at frequencies from 30 to 512 MHz; the Tadiran PNR-1000A personal network radio that integrates voice communications with a C4I application computing unit; and the Tadiran PNR-500 personal net radio that enables three-way conferencing on one communications channel, which operates at 410 to 450 MHz.

Dominator also works with the Elbit S-NAV smart infantry location and tracking device; COMBAT-NG artillery C4I system; improvised explosive device (IED) jammer; LILY lightweight thermal imaging weapon sights; MARS uncooled hand-held thermal imager; CORAL-LS medium-range hand-held thermal cameras; and other networked battlefield communications gear.

Robot on your shoulder keeps a friend (or parent) close

4 hrs.

Ever feel like you have a little person on your shoulder keeping track of your every move, providing encouragement to keep up the good work or stop you from doing something bad?

That little person may soon be more than just your conscience; it could be a robot that provides real-time interaction between you and a remote friend (or parent) as you do what you do.

Imagine going on a trip, for example, and bringing along your best friend who?s stuck at home, or sticking a robot on your child?s shoulder to remotely chaperone a Friday night out.

The robot, known as the miniature humanoid, or MH-2, is under development at Yamagata University in Japan. It has head and body moves like a person. It even breathes like one.

The idea is that a person stands in front a TV screen or an immersive display with a sensor such as a Kinect. This person sees whatever the person with the robot sees.

?Meanwhile, the robot on your shoulder acts like an avatar, duplicating the speech and gestures of your friend right there for you to interact with directly,? IEEE reports in its Automation blog.?

For now, the robot is controlled by servos in a 22 pound backpack, which would make bringing along a friend for every moment of a trip quite cumbersome, as well as awkwardly geeky.

But when the telepresence technology catches up with the imagination as illustrated in the video clip below, this could serve to keep friends and family close when they physically far apart.

How To Maximize Your Fsbo Marketing Dollars

The number one thing that you can do to improve the odds of selling your house in a timely manner is to get it listed in the MLS. Why? Because the multiple listing service is where most people find the home that they are going to buy.

Of course there are other marketing mediums, including billboards, classifieds, newspaper ads,een slechte adem, fsbo websites, and more, however, none of them have the reach and power of the MLS. Why does the MLS work so well? Because it combines the two leading sources of homebuyers, the Internet and real estate brokers.

How does this work? The MLS is not just a database for real estate brokers, it is also the most widely syndicated real estate content on the Internet. What does that mean? It means that when you list your home in the MLS,koska kannettavien tietokoneiden, you are not only letting the Realtors know about it, but it will also be included on thousands of real estate websites all across the Internet.

So what do you do if you cannot afford to hire a full service real estate broker? Well, one of the more interesting facts of hiring a real estate broker is that when you hire a listing broker, you are in essence hiring two brokers. The listing agent is the broker that represents you, and the buyers broker is typically a different person that you must also pay out of your proceeds.

Thus, if you are willing to do most of the work of the listing broker for yourself, then you can at least cut your commission fees in half. However, one of the listing broker's primary responsibilities is to market your house, and that is one of the many responsibilities that you will have to take care of.

Like many people, you can try marketing your house as an FSBO, but in many cases that doesn't work, because most buyers like to buy their houses through a Realtor. One solution is hire a flat fee MLS broker for your listing agent, because they only cost a few hundred dollars and take no commissions. In order to put your listing in the MLS,First of all, you still will want to offer a commission to the buyers broker, but using a flat fee MLS listing, you have effectively saved 50% on your real estate commission fees!

Does it work? Many frustrated FSBO sellers have opted to hire a real estate broker, however, flat fee MLS is a hybrid option that allows you to still market your home as FSBO, while greatly increasing your chances of success when selling your home by owner, because it gives you access to the #1 real estate marketing tool.

It's still a good idea to advertise your home as much as possible, using all available methods,article1021, and its critical to take great pictures of your home so that it shows at its best. Thus, if you're willing to go the extra mile to save some money, then consider trying flat fee MLS before you give up on selling your home by owner.

elbert - Far End Camera Control and MPEG-4 Video Transport in ...

Abstract

With the development of computer networks and multimedia communications, video conferencing is applied more widely, and it has good prospects for the development and research value. H.323 and SIP is currently the two major video conferencing standard based on IP network, taking into account the interoperability and compatibility with the original standard H.320, this paper chose the H.323 protocol based on IP network as a framework for the video conference system architecture.Based on the analysis and research of H.323, this paper provided the architecture of the video conference system, and analysed the key module. It presented the superiority of TMS320DM6446 which is a video conferencing terminal. It researched and implemented the far end camera control and MPEG-4 video transport in video conferencing.Video conferencing based on IP network transmits real-time images, audio and other data. If adding far end camera control in the video conference system, the various movements of the far end camera would be controlled arbitrarily, it will greatly improve the effectiveness of remote monitoring. So researching the far end camera Control is very important. Through research and comparative analysis of the various far end camera control protocol, this paper adopted the H.224/H.281 as far end camera control protocol of video conference system. Through analysis of H.224/H.281, it researched the methods of H.224/H.281 far end camera control in the video conference system, gived the existing problems when adding H.224/H.281 in the H.323 system and gived the solution, provided the design and realization of H.224/H.281 far end camera control, and verified that the H.224/H.281 far end camera control is correct through testing.Video conferencing adopted H.323 uses the video compression standards H.261 and H.263, the two standards exist low-coding efficiency, low efficiency of transmission, low quality of reconstruction image, and so on. MPEG-4 is the international video codec standard which has the superior performance, improves low bit-rate compression and increases fault-tolerant, and has better performance than ever standards (H.261 and H.263).So it is significant to research the transport of MPEG-4 video in video conferencing.Through the research of MPEG-4 video standard and MPEG-4 key technologies, including the DCT, quantization, motion estimation and motion compensation and VLC coding technology, this paper researched MPEG-4 video transport method in the video conference system, gived the existing problems when adding MPEG-4 video transport in the H.323 system and gived the solution, designed and implemented the transport of MPEG-4 video, provided the MPEG-4 video transmission model. And through the experiment on the two standard video sequences, it compared and analysed the results of the MPEG-4 video transmission and H.263 video transmission, the results had been satisfactory.

"Skyrocketing" tuition--what is Gov. Romney's solution? | Kansas ...

Finally, since we live in a twenty-first century economy that increasingly demands a college education, efforts at improvement can't stop at high school's end. Students must have access to a wide variety of options that will give them the skills they need for successful careers. We must stop fueling skyrocketing tuition prices that put higher education out of reach for some and leave others with crushing debt. -Gov. Mitt Romney[1]

Let's grant that tuition is "skyrocketing." What could Gov. Romney be advocating as a way of putting higher education in reach without crushing debt?

Broadly speaking, there are two strategies

for making higher education accessible. First, someone other than the student could pay for some or all of the costs. Since public education began in the United States in the 19th century, there have been two ways of doing this. One of those ways is by having the people of a community agree to contribute money and pay for a school or university, even when these people are not students at the time. So for many years the people of the state of Kansas have agreed to contribute money to the building and operation of state colleges and universities. Similarly, the people of the country as a whole have sometimes agreed to support specific activities at universities--activities such as research into types of wheat that would grow best on the high plains, for example, or constructing buildings in which science classes can be taught--and the people of more limited communities have agreed to provide money for specific local institutions, such as the people of Barton County have done in building and operating Barton County Community College.

In addition to providing support for the construction or operation of a university, both the people of Kansas and the people of the country more generally have tried to fight the high cost of education by providing students with financial aid: scholarships, grants, and subsidized loans.

This strategy for keeping costs down has, however, become rather unpopular lately with some of the people of the community, particularly Republicans such as Gov. Romney. At Fort Hays State University, for example, 20 years ago the people of Kansas contributed about 75% of the cost of educating a student, and the student's tuition had to cover only 25% of the full cost. Now, however, the state contributes slightly less than the student does. So the people of Kansas have made students double their share of the costs. And this week Gov. Sam Brownback has signed into law a set of tax cuts that are projected by the state to produce a situation in which the current levels of state programs--including education--will exceed state revenue by about 36% in six years.[2] Because support for higher education is a significant part of the state budget--not as large as elementary and secondary education, but very significant nevertheless--it is very likely that the state will be cutting its support for students and their universities. Similarly, many representatives of the people at the national level have been advocating cutting aid to students through, for example, the Pell Grant program.[3]

So if Gov. Romney does not want to fight "skyrocketing tuition" and "crushing debt" by providing more support, what can he propose to do?

Well, the second broad strategy for making higher education more accessible would focus, of course, on lowering tuition and other costs of education. How can universities lower their costs? Again, there are a number of possibilities and combinations.

Some universities are trying to increase revenues from other sources. A few universities can make a profit by entertaining paying customers with athletic contests, though most cannot. (22 turned a profit in 2010, though the average Division IA university lost $11.6 million in 2010 in its athletic program.[4]) More common is the attempt to increase revenue by contracting with government agencies or private enterprises to do research. Most common of all are the efforts aimed at securing donations. Furthermore, almost all institutions try to rent out meeting rooms and dorms and other facilities at times that does not conflict with their core missions. All of these efforts are important, and they do help to keep tuition down. But the prospects for any of these sources of revenue increasing very much are not good. Universities are already doing these things.

Besides increasing non-tuition revenues, universities can and do try to cut costs. Because the cost of teaching is normally the highest of those costs, this would mean that we would be trying to cut down on the cost of teaching. Here, too, there is a variety of ways that this could be done:
? Increasing the workload of the current range of faculty by eliminating research and / or service. Eliminating service means that communities would go down in the quality of life in some ways, while eliminating time for research would mean that faculty members would not be keeping up with developments in the field, although there would also be fewer developments. Would we have been happy if there had been no technological or medical developments since the 1950's?
? Increasing the workload of the faculty by having them teach bigger classes. Although smaller classes are normally associated with a higher quality of education, larger classes--especially those in which a faculty member can be assisted by a graduate student or by technology--are being put into use in many universities.
? Relying upon more poorly paid part-time instructors. This, too, is becoming quite common among larger universities (nationwide about 30% were part-time or temporary faculty in 1975, but that had climbed to about 48% in 2005; when compared on an hourly basis, these part-time or temporary faculty earn 22 to 40% less than full-time core faculty members do[5]).
? Outsourcing the teaching to faculty in or from nations in which faculty work more cheaply than is done in the United States. Universities currently are hiring many faculty who are not from the United States, but the shortage of faculty members in many subjects has meant that faculty salaries have not dropped. On the other hand, a university could hire faculty who remain in their home country to teach American students over the internet. One would expect that there could be some quality control problems in this latter sort of situation, but it may be a way of cutting costs and fighting the "skyrocketing" of tuition.
? Or, of course, just pay faculty less. As obvious as it may seem, that is not such an obvious solution either. Those who get a doctoral degree or another so-called terminal degree are among the top 10% of the American people in terms of education, yet salaries paid by universities do not put their faculties among the top 10% in terms of income. Hiring faculty is, in fact, competitive; well qualified and high performing faculty often turn down one university to teach at another or to go into the private sector. So if pay were cut at public universities, they would in all likelihood lose a number of their high performing faculty.

The cost of higher education is a significant barrier for many prospective students. Gov. Romney, and others who wish to combat the high cost of tuition, have only a few arrows in their quiver. Basically, they can entrust higher education more to computers, to part-time instructors, to the more poorly performing instructor, or to the outsourcing of education.

If we vote this type of person into office, we should not be so surprised if he does what he says he will do.

Brazil forest law parts vetoed

Brazilian President Dilma Rousseff has vetoed parts of a controversial bill which regulates how much land farmers must preserve as forest.

Among the 12 articles which President Rousseff rejected is an amnesty for illegal loggers.

Brazil's farmers' lobby had argued that an easing of environmental restrictions would promote food production.

Environmentalists oppose the law, which the say will lead to further destruction of the Amazon rainforest.

The bill was approved by the Brazilian Congress a month ago. Environmentalists had urged President Rousseff to veto the entire bill.

President Rousseff rejected 12 articles from the bill and made 32 modifications to the text.

The exact details of the revised document have not yet been made public, but Brazilian Environment Minister Izabella Teixeira said the government wanted to avoid diminishing protected areas of the Amazon and other sensitive ecosystems.

Analysis

President Rousseff opted for a solution often used here for controversial issues: try to leave everybody more or less reasonably satisfied, if not totally happy, and postpone tough discussions for later.

She vetoed some aspects of the new law that most concerned environmentalists, such as loopholes reducing mandatory reforestation and an amnesty for past deforestation.

But environmental groups, supported by many celebrities and a vigorous social media campaign, will be unhappy because the new proposals still afford less protection than existing regulations.

The farming lobby, on the other hand, feels it got partial approval for a bill it supported, but farmers worry there will be less land available for agricultural use.

Ms Rousseff is due to issue presidential decrees to replace the vetoed articles but these also have to go through a deeply divided Congress, so this highly charged debate is far from over.

The version of the bill passed by the Brazilian Congress last month would have allowed for huge areas of the country, which had been illegally logged before July 2008, to be opened up to farming.

It would also have allowed farming closer to riverbanks, which are especially vulnerable to erosion if trees are chopped down.

Officials said Ms Rousseff had rejected the article dealing with the riverbanks, ensuring their continued protection.

At a news conference, the ministers for the environment, agriculture and development said the president had struck a balance between preservation and sustainable development.

Brazil's farmers have long pushed for changes to the forest code.

They argue that uncertainty over the current legislation has undermined investment in the agriculture sector, which accounts for more than 5% of GDP.

But environmentalists campaigned for a total veto of the bill, which they said would spur deforestation in the Amazon rainforest.

Activist group Avaaz said it handed the government a petition with nearly two million signatures collected online from people in dozens of countries demanding a total veto.

The revised articles will now be sent back to Congress for another vote before they can come into force.

JB Williams ? Reform ? Making Illegal Immigration Legal ? CITIZEN ...

Governments have never been known to reform themselves and the current debate over immigration reform is no different than the notion that government will cut spending and clip its own wings. By reform, D.C. politicians mean, to make that which is currently illegal, legal.

Lawmakers have been stopped from passing amnesty for millions of illegal aliens living in America. But they have not been forced to enforce our immigration and naturalization laws and even when Border States attempt to enforce those laws, the federal government sues the state on behalf of illegal immigrants.

In a current piece issued by the Census Bureau, titled Minorities now surpass whites in US births, Bureau racial statistics chief Roderick Harrison states ? ?This is an important landmark.? ? ?This generation is growing up much more accustomed to diversity than its elders.?

Of course, most of those ?minorities? are in the United States illegally. This is of no great concern to Harrison. But what does concern Harrison is this ? ?We remain in a dangerous period where those appealing to anti-immigration elements are fueling a divisiveness and hostility that might take decades to overcome,? Harrison said.

For several years now, Americans have been wrongly accused of being ?anti-immigration? just because they want their immigration and naturalization laws to be enforced. But calling someone anti-immigration because they oppose illegal immigration is akin to calling them anti-banking because they oppose bank robbery.

Like many sniveling liberals today, Harrison completely ignores the fact that we are talking about criminals here, people who have broken into our country illegally and make a career out of flouting our laws and undermining American sovereignty and security. Harrison is not at all concerned with these facts, he is instead worried about Americans ?hostility? towards illegal invaders, as if Americans oppose immigration altogether.

America is an immigrant nation. But we are also a civilized society of laws. Under the false claim that Americas immigration and naturalization laws are just too stringent and unfair, progressives like Harrison spread false notions to support their call for immigration reform, otherwise known as blanket amnesty for all illegals and the end to American sovereignty and security.

Which unfair immigration and naturalization requirements should we get rid of???

Texas farmers use business wile to weather drought

(AP) ? Linda Galayda hauled water and flagged down truck drivers to ask about their hay. She sold calves and young cows and made her son leave their East Texas family ranch for a job in San Antonio.

About 200 miles southeast of her, Bob and Darlene Stryk heeded lessons from a dry spell 16 years ago and kept their 130-year-old farm afloat by selling higher-priced, specialty products like raw milk and cheddar cheese before the drought forced them to make their most difficult decision yet.

The drought that parched the vast Texas landscape, sucking dry ponds, lakes and reservoirs and severely damaging soil and grasslands, traumatized farmers and ranchers, who ? like their ancestors who survived the Dust Bowl and the dry spell of the 1950s ? will tell tales about the drought for generations.

The drought of 2011 cost $7.6 billion in crop losses, the most ever recorded, and forced ranchers to slaughter millions of animals, cutting Texas' cattle herd to its smallest size since 1952.

Now, as they try to recover and plan for the future, Galayda and Stryk share their stories, offering a peek at life during the worst one-year drought in Texas history.

___

For months, Galayda lived in constant fear for her "girls," the herd of cows that hark back to her late father. There was no grass or hay. Two springs that flowed even during a decade-long dry spell in the 1950s ? which serves as Texas' drought barometer ? dried up. Wildfires raged just two miles from the rolling hills of the 7-7 Ranch in Elkhart.

Even now, after the fires are out, Galayda's hand clenches when she talks about the helplessness and all-consuming fear of knowing an uncontrollable blaze could rip across the 2,500 acres she ranches, destroying generations of work.

"We've all heard stories about droughts of years past, but this one was," Galayda pauses, searching for the perfect word.

"Awful."

It took every ounce of business acumen ? much of it acquired during the 25 years she pounded the New York pavement in stillettos as a vice president at today's Macys ? to make it through last winter with a herd.

This time, instead of designer heels, Galayda wore Wranglers and cowboy boots when executing her carefully conceived business plan. First, before the spring of 2011, she looked over the livestock. Cows that weren't pregnant, heifers ? or young females ? with the smallest deficiency and other any less-than-perfect bovine was sold.

In the spring, excessive wind sucked the last moisture from the soil. The rain stopped. Grass disappeared. And there was no hay in Texas.

"I actually flagged down trucks that were carrying quality hay ... and asked them 'Where's this hay coming from?'" Galayda said with a laugh, recalling how she stopped drivers bringing hay to her neighbors to see if she couldn't get some as well.

Trucks rolled in, sometimes in the dead of night. Galayda's husband, Gary, unloaded bales at 4 a.m. The entire family ? sons Christopher and Scott Crawford, and his wife, Rebekah, pitched in. The ranch spent all the cash reserves, about $140,000, to buy hay. Scott dipped into his savings. Christopher got a job in San Antonio.

The family got rid of more animals, losing money as calves were sold early and at lower-than-normal weight. Heifers normally used to restock were also sold.

By August, the heat was so intense, with weeks of 100-degree days with no rain, that Galayda and two cowboys began work at 4:30 a.m., relying on their horses to get them through the pitch black safely. They moved cows to smaller pastures, trying to decrease the distance the animals had to walk to hauled-in water. By 10:30 a.m., it was too hot to work.

"The cows were grazing at night ... if they grazed at all," Galayda said.

Finally, in January, it rained. The creeks, ponds and lake refilled. The cows gave birth. The grass grew green.

Things were different, though. Some calves came later. A few got sick. The vet blamed anything odd on the drought.

"Everything was just not as it normally is," Galayda said. "You can help her (a cow) so much, but nothing, nothing takes the place of green grass."

This spring, the rain has slowed. Galayda's herd is smaller ? down to about 370 head from a pre-drought high of 500 ? but she is cautious, not yet ready to restock. The land, she believes, needs to heal. She does, too.

"I don't think anybody's back in a position yet to say this is over with."

___

On the Stryk Jersey Farm, in Engle, Texas, the situation also was tense.

By fall, the hay barn was empty ? a first in Darlene and Bob Stryk's 26-year marriage. And the pond was mud, also a first since the Stryk family purchased the farm in 1882.

Every three or four days, they filled a 1,500-gallon water tank for the heifers. Each time, they prayed the well wouldn't dry up too.

They already knew drought.

It nearly ran them out of business in 1996. Then, hay was expensive, and milk was cheap. Darlene Stryk took a "town" job, wandering around the state with a cow in a truck, teaching children about dairy operations. Bob Stryk worked as a mechanic. Their debt was enormous. Something had to change, or all would be lost.

They cut their herd from 140 dairy cows to 25 and launched Strykly Texas Cheese, covering blocks of cheddar shaped like Texas, jalapenos and cowboy boots with wax by hand to fill gift baskets. As the business grew, they gradually built their herd back up to 60 head.

A neighbor's bull jumped the fence, and a small beef herd was born.

Each year, though, milk sales failed to cover the animals' feed costs, and they had to transfer money from the burgeoning cheese business to make up the difference. So, in 2006, they got a state license to sell raw, or unpasteurized, non-homogenized milk, to a niche market of people often interested in organic products and buying directly from farms.

Despite the health risks associated with drinking unpasteurized milk, which can contain harmful bacteria, the Stryks were confident in their business plan. They drink their own milk and undergo rigorous state inspections to keep their license.

Within three years, the Stryks, able to earn about double by selling directly to consumers rather than wholesalers, stopped selling to large dairies. They started making their own cheese. They sold grass-fed beef.

Then, in 2010, the rain stopped again. Grass dried up, and hay prices skyrocket. It was time, again, to decide.

"We had to sell all our beef cattle because it was either feed the Jerseys, who were able to produce milk daily and give us financial security, versus a beef herd, which you only sell a calf once a year," Darlene Stryk explained.

A week later, it rained.

"And basically, it's been raining ever since," Darlene Stryk said with a touch of irony. "We rolled the dice, and Mother Nature won once again."

Now, the pastures are green. The creeks are full, but the land is still fragile. Cattle prices are rising, and they too aren't yet willing to invest in a beef herd that will cost more than the one they sold.

They are thankful for the steady sales of raw milk and cheese that saved them. It was, they believe, customer loyalty, the intimacy created when people buy their product directly from the farm, that kept them afloat this time.

"We would not be in the dairy business if it had not been for the retail raw milk permit," Stryk explained.

And so, they wait, and heal along with the land.

E.T.: The Extra-Terrestrial Blu-ray trailer and box art pop up online (video)

E.T.: The Extra-Terrestrial Blu-ray trailer and box art pop up online (video)

Ever since Universal announced during CES 2012 that it would deliver many of its classic films on Blu-ray this year as part of a centennial celebration, we've been keeping a careful eye out for news regarding Steven Spielberg's classic E.T.: The Extra-Terrestrial. While we still don't know the release date, price or if it will contain the changes made in the 2002 edition of the flick, Universal posted a trailer for the Blu-ray (embedded after the break, note that at 0:25 seconds the FBI agents are holding guns, so it appears to be the original) that confirmed a digital remastering from the 35MM film, 7.1 surround sound and "hours of bonus features". Additionally, forum posters on Blu-ray.com have noticed this (probably not final) box art appearing on Amazon UK recently. After waiting for word since a new distribution deal brought the flick back to Universal in 2008, a few months of silence hasn't broken us, but hopefully more details appear soon. The best guess still sees the 30th Anniversary release hitting store shelves in time for the holidays (likely after Jaws, which is scheduled for release August 14th), when we can relive our childhoods in proper 1080p HD at last.
